PROCESS TIME

 

Documents prepared for change of address are submitted to TÜRSAB to be forwarded to the Ministry. TÜRSAB reviews the application file and evaluates whether the travel agency's business premises at the reported central or branch address meet the qualifications specified in Article 17 of the Travel Agencies Regulation, and whether records of personnel are kept.

TÜRSAB informs the relevant Ministry of its opinion on the application result. If the application is not deemed appropriate, the applicant is informed of the reason. The file for the address change application deemed appropriate is forwarded to the Ministry by TÜRSAB. The file for the address change application submitted to the Ministry is examined by the Ministry. In case of any deficiencies found during the examination by the Ministry, TÜRSAB is notified to complete the deficiencies. If the request is deemed appropriate, a "Makam Onayı" (official approval) is prepared for the issuance of the new travel agency business license according to the new address. After the "Makam Onayı," the new business license is issued and delivered by the Provincial Directorate of Culture and Tourism.

 

PENAL SANCTIONS

 

According to Article 10(d) of Law No. 1618 on Travel Agencies and the Association of Travel Agencies: "(*) Changes of address, including those of branches, must be reported to the Ministry at least 10 (ten) days in advance without any changes", and Article 27(a)(2) of the same Law states: "In the event of a violation of Article 7, 17, 19, or 21 or Article 10(c), (ç), or (d), an administrative fine shall be imposed. Therefore, a travel agency that fails to report an address change on time shall be subject to an administrative fine determined under the Article 27(a)(2) of Law No. 1618, depending on the year in which the violation occurs.

(*) The first (1st) sub-paragraph of Article 21 of the Travel Agencies Regulation states: "Written notifications to TÜRSAB regarding change requests shall be deemed to have been made to the Ministry." and the eighth sub-paragraph states: "If the application letter is submitted directly to the Ministry, it shall be sent to TÜRSAB for evaluation." These provisions are binding. Therefore, the change of address must be notified to TÜRSAB in writing at least 10 days before the change is made.

(!) If the existing personnel are no longer employed, the application file must contain;

  • One of the documents defined in the qualifications of the personnel to be employed as stated in the Travel Agencies Regulation. (See Personnel Change)
  • It is necessary to have an SSI Service List indicating that the personnel whose documents are presented are employed within the company or an SSI Work Entry Declaration if the personnel have not yet started working.

SGK (Social Security Institution) Job Entry Declaration or the SGK Insured Service List indicating that the personnel whose documents are submitted are currently working in the company

Commercial Registry Certificate prepared in accordance with Article 16 of the Commercial Registry Regulation; MERSIS number, trade name, name and surname of the business owner in sole proprietorships, place of residence and identity number, business headquarters, the branch address along with the company's central address, business field of activity, the capital allocated to the business, the document that shows the individuals authorized to represent the company at the time of document issuance.

 

FREQUENTLY ASKED QUESTIONS

 

1. We have registered and announced our address change in the Trade Registry, what should we do now?

Please complete the address change file content, otherwise, you may face administrative procedures due to operating without a business license.

2. What are the business property qualifications sought at the new address?

During the address audit, the qualifications defined in article 7 of Law No. 1618 and article 17 of the relevant regulation are sought.

3. What are the mandatory personnel documents required for employment in a Travel Agency?

In accordance with the legislation, at least 1 (one) personnel with any of the following documents must be employed in a Travel Agency:

  • A certified copy of the diploma showing that the person has completed vocational high school, associate or bachelor's degree in hotel management and tourism, or a verifiable document obtained from E-Government that shows the person has graduated,
  • Original foreign language proficiency certificate for information officers, an original or notarized copy of the guide certificate issued by the Ministry demonstrating that the person is the holder of a guide certificate.

! If a person who has previously presented any of these documents continues to work, the personnel certificate is stored in digital and physical form in the agency's registry, and it is not necessary to present the document again!

4. Is it possible to transfer the Travel Agency's activity between the company's branches?

The business license of the Travel Agency can be transferred between the company's branches. However, since this transaction cannot be registered and announced in the Trade Registry as an "address change," the change should be carried out by the company's authorized decision. In this context, in order not to face administrative fines imposed by the Ministry, the address change application to TÜRSAB must be made at least 10 days before the authorized decision to be taken.
